Dismissal in Under 1 Year

An Employment Appeals Tribunal confirmed the ‘one-year’ rule of unfair dismissal – employees must have worked continuously for one firm for one year to gain the right to claim:

• The employee’s case – employee Harper claimed that as she’d worked for less than one year, she’d lost the chance to claim for unfair dismissal. The first tribunal agreed.
• The EAT ruling found that an employee with less than 12 months continuous service hasn’t ‘lost the opportunity to claim unfair dismissal’ – they just never had it
